Pillar 2 requirement

The Pillar 2 requirement is a bank-specific capital requirement which applies in addition to the minimum capital requirement (known as Pillar 1) where this underestimates or does not cover certain risks. A bank’s Pillar 2 requirement is determined as part of the Supervisory Review and Evaluation Process (SREP). The requirement is legally binding, and if banks fail to comply with it they could be subject to supervisory measures, including sanctions. The Pillar 2 requirement does not encompass the risk of excessive leverage, which is covered by the leverage ratio Pillar 2 requirement.

In addition to complying with the Pillar 2 requirement, banks are expected to follow the Pillar 2 guidance issued by the ECB. This indicates the level of capital that they should maintain to be able to withstand periods of financial stress. Unlike the Pillar 2 requirement, the Pillar 2 guidance is not legally binding, as it only reflects supervisory expectations.

Under Articles 431(1), 433a(1) and 438(b) of the revised Capital Requirements Regulation, large institutions (as defined in Article 4(1)(146) of the same Regulation) are required to disclose their Pillar 2 requirements on an annual basis.

The ECB is also continuing its recent practice of publishing the consolidated Pillar 2 requirements of all the significant institutions it supervises after obtaining their consent to publication. The table below shows the significant institutions under direct ECB supervision in 2020, 2021 and 2022 and their Pillar 2 requirements for those years. All significant institutions that received a SREP decision in 2022 have been asked to consent to the publication of their Pillar 2 requirements and leverage ratio Pillar 2 requirements for future SREP cycles too. They can withdraw their consent at any time.

If a bank was not subject to a Pillar 2 requirement in 2022, the currently applicable Pillar 2 requirement determined in a previous SREP decision is included. This is indicated in the table by an asterisk (*).

In line with the principles of the ECB Guide on the supervisory approach to consolidation in the banking sector, HSBC Continental Europe was not subject to the regular timeline of the 2022 SREP exercise since had embarked on a consolidation operation. Once a new capital decision is adopted in respect of HSBC Continental Europe, the applicable Pillar 2 requirement will be published. Until then, HSBC Continental Europe remains subject to the own funds requirements set out in the previous SREP decision.
  5. The consolidated prudential perimeter that was subject to the Pillar 2 requirement has ceased to exist. As a result, the institution is not subject to a Pillar 2 requirement.
