Public consultation on draft revisions to options and discretions policies
This consultation gave interested parties the opportunity to comment on draft revisions to the ECB's policies concerning the exercise of options and discretions in Union law.
In response to a stakeholder request, we published an additional copy of the Guide in which the draft revisions are highlighted, available in English only. In order to allow time for examining the additional document, we also extended the deadline for submitting comments to the public consultation by one week, to 30 August 2021.

In 2016, the ECB first harmonised the way options and discretions granted to supervisory authorities are exercised in the countries participating in the Single Supervisory Mechanism.
The ECB’s policies concerning options and discretions are laid down in four instruments:
- an ECB Guide and an ECB Regulation setting out how the ECB exercises options and discretions for significant institutions, which it supervises directly
- an ECB Recommendation and an ECB Guideline addressed to the national competent authorities of countries participating in the Single Supervisory Mechanism, which request that they adopt similar policies in their direct supervision of less significant institutions
The ECB proposed revisions to these four instruments to account for legislative changes adopted since their publication, in particular the introduction of the CRR II/CRD V package.
